These Terms and Conditions govern access to and use of the real estate crowdlending platform operated by Infotivo SpA (hereinafter, "Infotivo", "we" or "the Platform"). By accessing or using our services, you agree to be bound by these terms.
1. Definitions
Platform: refers to the website infotivo.com and its associated applications. User: any person who accesses or uses the Platform. Investor: a registered user who makes investments through the Platform. Project: real estate development available for investment through the Platform. Developer: legal entity that presents real estate projects for collective financing.
2. Registration and account
To use Infotivo's investment services, you must create an account by providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and for all activities carried out under your account. We reserve the right to suspend or cancel accounts that violate these terms or that show signs of fraudulent activity.
3. Nature of the service
Infotivo operates as an intermediation platform that connects investors with real estate projects in Chile. We are not a bank, a financial institution regulated by the SBIF, nor a stockbroker. Investments made through the Platform carry inherent risks, including the possible partial or total loss of invested capital. Infotivo does not guarantee specific returns or profitability.
4. Investment process
Each project published on the Platform includes detailed information about its characteristics, estimated timelines, projected returns, and associated risks. The decision to invest is solely the user's, who must carefully evaluate the information provided. Infotivo does not provide personalized financial advice. Once an investment is confirmed, it is subject to the specific terms of each project, which are detailed in the corresponding participation agreement.
5. Fees and costs
Infotivo charges a commission for its intermediation services, which is detailed in the information for each project before confirming the investment. There are no hidden costs. All applicable fees and expenses are communicated transparently before the formalization of any investment.
6. Responsibilities and limitations
Infotivo acts as an intermediary and is not responsible for the success or failure of real estate projects. We commit to conducting diligent evaluation of each project and developer before publishing them on the Platform, but we cannot guarantee the successful completion of any project. The user acknowledges and accepts that all investments carry risks and that Infotivo shall not be liable for losses arising from investments made.
7. Intellectual property
All content on the Platform, including texts, graphics, logos, images, software, and its design, are the property of Infotivo SpA or its licensors and are protected by Chile's intellectual property laws and applicable international treaties. Reproduction, distribution, or modification of content without express written authorization is prohibited.
8. Applicable law and dispute resolution
These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute arising from the use of the Platform shall be submitted to the jurisdiction of the ordinary courts of Santiago de Chile, with the parties waiving any other jurisdiction that may correspond to them. An attempt will be made to resolve any dispute amicably before resorting to judicial proceedings.
9. Modifications
Infotivo reserves the right to modify these Terms and Conditions at any time. Changes will take effect upon publication on the Platform. Continued use of the services after any modification constitutes acceptance of the new terms. For significant changes, registered users will be notified at least 15 days in advance.
