At Infotivo SpA (hereinafter, "Infotivo", "we" or "the Platform"), we are committed to protecting the privacy of our users. This Privacy Policy describes how we collect, use, store, and protect the personal information you provide when using our real estate crowdlending services.
1. Information we collect
We collect information that you provide directly when registering on the platform, making investments, or communicating with us. This includes: full name, email address, phone number, RUT or identification document, financial information necessary for the investment process, postal address, and professional contact details. Additionally, we automatically collect certain technical information when you use our platform, such as your IP address, browser type, pages visited, time spent, and interaction data with the platform.
2. Use of information
We use the collected information for the following purposes: to facilitate and manage your investments in real estate projects through our platform; to verify your identity in accordance with current regulations in Chile, including anti-money laundering regulations (Law No. 19,913); to communicate relevant information about your investments, project updates, and changes to our services; to improve and personalize your experience on the platform; to comply with legal and regulatory obligations before the CMF and other competent authorities; and to respond to your inquiries and support requests.
3. Data sharing
We do not sell or rent your personal information to third parties. We may share your data in the following circumstances: with service providers who assist us in operating the platform (payment processing, data storage, analytics), under strict confidentiality agreements; with regulatory or judicial authorities when required by law or court order; with participating real estate developers, limited to information strictly necessary for managing your investment; in the event of a merger, acquisition, or asset sale, with prior notice to users.
4. Data security
We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, loss, alteration, or disclosure. This includes encryption of data in transit and at rest using TLS 1.3 and AES-256 protocols, role-based access controls, periodic security audits conducted by independent third parties, and incident response plans in accordance with current Chilean regulations.
5. Your rights
In accordance with Law No. 19,628 on Protection of Private Life and its amendments, you have the right to: access your personal data stored on our platform; rectify any inaccurate or outdated data; request the deletion of your data when it is no longer necessary for the purposes for which it was collected; object to the processing of your data for direct marketing purposes; request the portability of your data in a structured format. 6. Data retention
We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including legal, accounting, or reporting obligations. Investment-related data is retained for a minimum of 5 years after the completion of the investment, in accordance with Chilean financial regulations.
7. Changes to this policy
We reserve the right to update this Privacy Policy periodically. Any significant changes will be notified through the platform or by email at least 30 days in advance. The date of the last update is indicated at the beginning of this document.
